Braxton Haley’s criminal case dismissal has been amended, and the murder charge is now dismissed without prejudice.
A Barren County grand jury originally returned the “Not True Bill” against Haley on Thursday, Feb. 19, specifying that the charges were dismissed with prejudice, meaning the specific charges could not be brought up again. During the 10 a.m. session of the Barren County Circuit Court, judge John Alexander amended the dismissal to be without prejudice. Travis Lock, Haley’s attorney, did not object.
“We would love for it to be with prejudice but I think [the statute] speaks for itself,” Lock said.
This is a small change, but it allows the case to be brought up again in the future. Previously, Commonwealth’s Attorney John Gardner told Glasgow News 1 that this change is only to amend an error and does not indicate that he necessarily plans to retry the case.
Lock also made the motion that Haley’s property be returned, which met with no objection from Gardner.
Haley, 21, was arrested by Glasgow police on Frazier Avenue in connection with the shooting death of Justin Satterly.
