Double murder trial postponed

GLASGOW – The trial for a Glasgow man charged with the murder of his brother and sister-in-law has been postponed.

Cody N. Bacon, 22, was indicted on Oct. 27, 2021, on two counts of murder and first-degree wanton endangerment after he allegedly shot his brother and sister-in-law on Sept. 2, 2021.

David A. Pace, 24, and Brittany R. Pace, 22, both of Glasgow, were shot to death at a home located at 310 N. Race St. Bacon reportedly called 911 to report he had shot them.

Court records obtained by WCLU News indicate that Candace Hill, the public attorney representing Bacon, filed a motion to continue – a request to reschedule a currently set court date – on April 3. The case was originally set to go to trial on Aug. 15.

“The cause of the delay is not purposeful or the fault of the defendant, but simply a result of counsel needing more time to evaluate, investigate, organize experts to evaluate the case and prepare for trial, and take the necessary steps to provide competent counsel to Mr. Bacon,” the motion said.

The motion was approved Monday by Circuit Judge John Alexander. The court records said Commonwealth Attorney John Gardner did not object to the continuance in the case.

Gardner is seeking the death penalty for Bacon.

A discovery conference is scheduled for Monday, May 22 at 1 p.m. A later pre-trial conference is also scheduled for June 26 at 1 p.m.
