Caverna schools likely to face lawsuit

The Caverna Independent School District has received a letter signed by two attorneys signifying a possible lawsuit is forthcoming.

The district was notified of the intended legal action in a letter addressed to Caverna High School Principal Frank Beauchamp and district superintendent Amanda Abell. The letter is signed by both attorney Johnny Bell and attorney Bobby Richardson.

“This letter serves as formal notice that…a student at Caverna High School was subjected to serious physical and emotional abuse by a school employee…who beat him with a belt and permitted other students to participate in this abuse,” the letter stated. “We intend to pursue legal action against the individuals involved, as well as the school district, for violations of civil rights, assault, battery, negligent supervision and potential hate crimes.”

Given the students ethnicity, the letter states the abuse “appears to be racially motivated.”

Aside from the claims, the letter demands “the immediate preservation of all evidence related” to the alleged crime, specifically the letter requests the preservation of surveillance footage, written statements regarding the issue, records of prior misconduct, incident reports and student complaints.

Abell wrote in an email that Mike Owsley is the board’s attorney. She also said the district had only received the letter so far; no court cases are currently filed against the school district, Abell or Beauchamp in Barren County or Hart County.

The possible legal issue stems from the video circulated on social media that led to former boys’ basketball coach Terrence Miles, who resigned from the school on May 2 and who was soon thereafter arrested by Horse Cave police.
