A federal judge has dismissed the lawsuit filed against the city of Glasgow, the Glasgow Police Department and three police officers.
The lawsuit stems from the death of Jeremy Marr on April 14, 2020. According to the court document, three police officers “allegedly forced Marr to the ground with their knees in his back and tased [sic] him several times.” He was then transported to the emergency room and pronounced dead upon arrival.
The Kentucky Medical Examiner’s Office later determined Marr died from “agitated/excited delirium complicating acute methamphetamine intoxication.” They also did not find any evidence of lethal trauma, according to prior reporting.
Judge Greg N. Stiver with the Western District of Kentucky dismissed the cruel and unusual punishment claim, all claims against the three police officers in their official capacities and all claims against the Glasgow Police Department, after a summary judgement was requested by the defendants. The lawsuit was dismissed with prejudice, but it can appealed to a higher court.
