Details on medical cannabis “opt-in” explained to Cave City officials

Jun 11, 2024 | 9:02 AM

CAVE CITY, KY  –  At the last city council meeting for the city of Cave City, the council approved to opt in to allowing business to be conducted in the city involving the distribution of medical marijuana.  Local governments have the ability to opt out of this type of business, as well.   Each municipality can determine it’s own course of action.

With Cave City opting in, that still doesn’t mean that a dispensary or manufacturing center will be coming to the area.  Kevin Myatt, Director of the Planning and Zoning Commission, was at the meeting to answer questions and provide insight to the council.  Myatt said the 9 county region would be limited to 4 business due to the state limiting the program to 16 cultivators, 10 processors, and 48 dispensaries.

Myatt also said that public hearings would need to be held leading up to the 2025 legalization date, meaning those meetings would need to be advertised 30 days in advance.  Another new development is that a cannabis business can not be located within 1000 feet of a school or daycare facility.

With Cave City already opting in, they can still opt out by January 1st, 2025.  Zoning regulations were updated to reflect that.  However, if a municipality has not taken action to opt out, they are already opted in.  To clarify, Cave City having opted in by way of government action, allows the city to move forward with necessary actions to even allow medical cannabis business.  As Myatt explains, the zoning changes can be reversed, should Cave City opt out of medical cannabis businesses in the future.

Also at the meeting, Councilwoman Beverly Ford made the motion that the Senior Park be named after the late City Administrator, Robert Smith.

The motion carried unanimously, with council members offering additional improvements to the park at a future date.
