Special judge appointed to preside over Garrett’s assault charge proceedings

GLASGOW, Ky. — A special judge has been appointed to serve over court matters concerning a local attorney’s assault charge.

Shawn “Ken” Garrett is charged with fourth degree assault with minor injury. The Glasgow Police Department served a criminal complaint summons to Garrett on Nov. 1.

Barren District Judge Gabriel Pendleton typically oversees cases like Garrett’s. The judge filed a request Nov. 4 for a reassignment since Garrett is a local attorney.

Judge Steven R. Crebessa will preside over the case. He is the 46th Judicial District judge, which covers the Breckinridge, Grayson and Meade County areas.

Garrett’s assault charge stems from a June 20 event. He apparently “intentionally or wantonly caused physical injury” to a 14 -year-old child.

Garrett struck the child with a wooden board, which was used as wall décor in his home, across the buttocks. The attorney apparently struck the child several times before, the summons said.

“During the last paddling, defendant used so much force that he broke the wooden paddle into two pieces while delivering one strike,” according to the summons.

The paddle was approximately one inch thick. It was described as “solid wood.”

Garrett’s attorneys said the case’s claims are baseless.

“This case is solely the result of previously unfounded allegations following an acrimonious divorce,” said Jason Hays, co-counsel for Garrett, in a prepared statement Tuesday. “These identical claims have undergone two separate investigations by Social Services which found them unsubstantiated.”

The attorney said the charge is another attempt to “relitigate these baseless claims.”

The summons said Garrett caused the child substantial risk and extreme mental distress. The teenager has been diagnosed with PTSD, the summons said.

Garrett is scheduled to appear in court Nov. 29 at 8:30 a.m. Steven Romines is Garrett’s attorney.
