EATON FILES MOTION FOR A RELEASE PENDING APPEAL: GOVERNMENT FILES OPPOSITION MOTION PDF Print

J. Gutrie True, Attorney for Former Sheriff Chris Eaton filed a motion on August 26 for a Release Pending Appeal or a Stay of the sentence pending appeal. The motion states that it is urgent in nature since Eaton has been assigned to a facility hours from his home making it virtually impossible for his wife and five children to visit him. This is in spite of the fact that the Court recommended that the defendant serve his sentence at a facility in Kentucky.

The Government filled an Opposition Motion to Eaton's Motion For Release Pending Appeal on Wednesday, September 11. The Government argues that the court afforded Eaton the privilege of self-surrendering once the Bureau of Prisons notified him of a reporting date and they don't feel that Eaton has met his burden to make sufficient showing to support his motion for release or a stay of sentence pending appeal and ask the United States to deny his motion. This motion was submitted by Sanjay Patel and Roy ConnIII of the U S Department of Justice.
