EATON TRIAL BEGINS MONDAY; COUNSEL FOR GUFFEY SAYS THEY'VE NOT BEEN GIVEN ANY GRAND JURY DOCUMENTS FOR REVIEW PDF Print

With less than a week away from trial for Sheriff Chris Eaton, Deputy Aaron Bennett and Eric Guffey, an employee of the Barren- Edmonson County Drug Task Force, Eric Guffey and his counsel Brian Butler have filed a motion to receive the Grand Jury Material and any additional Witness Statements.

According to the document that was filed it states:

"Trial begins on April 29th.  As of today’s date, defense counsel has not received the Grand Jury material.  Given the United States’ prolific use of the Grand Jury, there is certainly a significant amount of material.  The only legitimate purpose for withholding this information is a concern for safety of a witness.  In this case, the parties are well aware of the potential witnesses and the defendants are law enforcement officers not gang members.  There is no legitimate reason to withhold the material.  Withholding the material is nothing more than gamesmanship.

Unfortunately for everyone, the United States’ gamesmanship is likely to slow down the trial as counsel attempt to review this material before undergoing cross examination.  This situation is not efficient.  It is not fair to counsel, the court or the jury.  It is likely to prolong this case beyond the week which it should take to try this case."

Eaton was indicted for Deprivation of Rights under Color of Law, three counts; Witness Tampering, two counts; Falsification of a Document, one count; False Statement, one count and Destruction of a Record, Document or Tangible Object, one count.

Bennett was indicted for Deprivation of Rights under Color of Law, one count and Making a False Statement, one count.

Guffey was indicted for Deprivation of Rights under Color of Law, two counts and Making a False Statement, two counts.The trial is scheduled to begin next Monday at 9am in Bowling Green.

Remember, an indictment is an accusation only and a person or persons are innocent until or unless proven guilty.
